CMS Soon to Drop Rule That May Involve Rescission of 80/20 Provision

The Centers for Medicare & Medicaid Services in a matter of days will be issuing a proposed rule that may include rescinding or revising the controversial 80/20 provision in the Medicaid Access Rule. The regulation now residing at the Office of Management and Budget follows an extensive review of finalized rules released in 2024, the OMB website said. These include the Medicaid and Children’s Health Insurance Program Managed Care Access, Finance and Quality Final Rule; and the Ensuring Access to Medicaid Services Final Rule, which contained the unpopular 80/20 provision, a mandate that requires that 80% of Medicaid payments for home health, personal care and homemaker services be spent on workers’ compensation.
