Private Equity Firm Welsh Carson Slams FTC Antitrust Lawsuit’s ‘Overreach’

Private equity firm Welsh Carson has asked a Houston federal judge to throw out the U.S. Federal Trade Commission’s antitrust lawsuit against the company, accusing the agency of pushing an “aggressive new litigation agenda.” Attorneys for Welsh Carson in a motion to dismiss blasted the FTC’s September lawsuit against the New York-based buyout firm and a company it invested in, U.S. Anesthesia Partners. The FTC alleged Welsh Carson and U.S. Anesthesia Partners moved to consolidate the anesthesiology market in Texas, suppressing competition and driving up prices in violation of U.S. antitrust law. Welsh Carson’s lawyers countered that the FTC’s complaint against “mere investors” was “turning decades of settled corporate law on its head.”
