PE firms have made significant investments in health care over the past few decades. Using a variety of structures that enable them to invest in health care through management and leasing arrangements, these for-profit entities have had both financial successes and failures. While general federal and state health care regulations apply to PE, regulation expressly addressing PE arrangements in health care continues to evolve, and the legal landscape is changing. Practical Law asked Michele Masucci, Jéna Grady, Jennifer Greco, and Marissa Espinoza Icochea of Nixon Peabody to describe the challenges facing PE firms involved in health care.
