A pair of recent Supreme Court decisions that sapped power from federal regulatory agencies may give Congress another reason to finally pass pharmacy benefit manager bills that have stalled for months. Most importantly, the ruling on Loper Bright Enterprises v. Raimondo overturned the so-called Chevron deference doctrine that guided federal jurisprudence for 40 years by directing courts to accede to regulators when statutory language is unclear. And in Securities and Exchange Commission v. Jarkesy, the Supreme Court weakened the ability of agencies to assess fines. That’s why GOP lawmakers see now as the time for Congress to take the reins on PBMs.
