The Trump administration announced plans to issue a proposed rule under the Mental Health Parity and Addiction Equity Act (MHPAEA) that will include significant revisions to Biden-era provisions. The future of mental health parity has been hazy for providers. In September of 2024, the Biden administration released its final rule updating mental health parity compliance for payer organizations. The rule updated how federal agencies oversee whether health plans treat behavioral health benefits differently from physical health benefits, and required health plans to analyze nonquantitative treatment limitations (NQTL) for both types of benefits.
